Rhys Duncan

Overview

Rhys’ practice spans the full scope of Chambers’ core property, insolvency, and wider chancery practice areas. He is regularly instructed on complex cases in the County Court and First Tier Tribunal, and is frequently instructed on matters in the High Court.

Rhys read Jurisprudence at Trinity College, University of Oxford, before completing his Bar Course with Distinction from the Inns of Court College of Advocacy.

Commercial Property

Rhys is regularly instructed on forfeiture and associated commercial possession proceedings, and advises on contested notices under the Landlord and Tenant Act 1954.

Enfranchisement

Rhys has experience of leasehold enfranchisement, lease extensions, and associated right to manage applications.

Insolvency and Company

Rhys’ insolvency and company practice includes the following:

Winding up petitions, including contested petitions, for both petitioners and companies.

Bankruptcy petitions.

Applications to determine a liquidator’s remuneration.

Applications to rectify the charges register following the registration of an incorrect charge.

Real Property

Rhys’ real property practice spans the full scope of property issues, including:

Boundary disputes relating to residential and development land.

Cases concerning estoppel, co-ownership, and trusts of land.

Easements and rights of way.

Restrictive covenants, breach of covenant, and nuisance.

Trespass.

His work in these areas includes drafting, advisory work, and representation in both the County Court and First-Tier Tribunal.

Residential Property

Rhys regularly deals with all forms of residential possession claims, with a focus on high value properties, cases with complex ownership structures, and mortgages. This is in addition to his work on disrepair claims for and against freeholders, intermediate landlords, and tenants, and frequent instructions to obtain injunctions, in particular in relation to access covenants.

Rhys’ practice also extends to a range of service charge, administrative charge, and estate charge disputes in both the First-Tier Tribunal and County Court.
