In the recent case of Birch v Meredith (unreported, 9-13 September 2024) the Court was asked to consider a claim for misrepresentation and harassment arising out of the sale of a flat in Arundel in 2016.

Phillip Rainey KC, Marc Glover, Andrew Martin, and Sami Allan appeared in the Supreme Court from 13 – 15 May 2025 in the case of Mitchell v Al Jaber, in which they represented Sheikh Mohammed Bin Issa Al Jaber (“the Sheikh”). The underlying dispute concerns breach of fiduciary duties, the calculation of equitable compensation, and the exclusion of unpaid vendor’s liens.
The Supreme Court were hearing two separate appeals from the Court of Appeal’s decision in [2024] EWCA Civ 423, in which the Sheikh was the overall successful party.
It is likely that the Supreme Court’s forthcoming decision will be the leading authority in this difficult and important area of law.
