Andrew Butler KC has been instructed by the Secretary of State for Housing, Communities and Local Government in two forthcoming high-profile Building Safety Act appeals.

Andrew, who co-edited the first textbook on the Act (the Law Society’s 2024 publication “The Building Safety Act: A Property Practitioner’s Guide”) was instructed on the Secretary of State’s applications to intervene on Ardmore Construction Group Ltd. (in administration & ors -v- Crest Nicholson Regeneration Ltd. & ors (“Ardmore”) and Edgewater (Stevenage) Ltd. & ors -v- Grey GR LLP (“Edgewater”). Ardmore concerns Building Liability Orders under s.130 of the Act; Edgewater concerns Remediation Contribution Orders under s.124.

Permission to intervene on both cases has now been granted by the Court of Appeal. Ardmore will be heard on 16/17 December; Edgewater is due to be heard in March 2027.

Andrew is instructed by the Government Legal Department and leads Samantha Jones (Ardmore) and Ruth Keating (Edgewater), both of 39 Essex Chambers. Barristers from Tanfield and 39 Essex collaborated on another textbook about the Act, the Sweet & Maxwell publication Dovar & Sawtell on the Building Safety Act. Andrew’s instruction on these cases further cements Tanfield’s status as a market-leading set in Building Safety Act work.
