Leasehold Reform (Notices) Regulations 1997 – New forms of LRA 1967 Enfranchisement Notices

On 22 January 2025, the Secretary of State made regulations implementing section 27 of the Leasehold and Freehold Reform Act 2024. These are the Leasehold and Freehold Reform Act 2024 (Commencement No. 2 and Transitional Provision) Regulations 2025. As widely leaked online, they remove the two year qualifying period for leasehold enfranchisement and lease extension claims under the Leasehold Reform Act 1967 and Leasehold Reform Housing and Urban Development Act 1993.
Less well publicised is reg.3 of the regulations. This makes transitional provisions modifying Forms 1 and 2 of the Leasehold Reform (Notices) Regulations 1997. As practitioners know, Form 1 is a Notice of Claim by a leaseholder for the freehold or an extended lease of a house under LRA 1967. There are no prescribed forms for lease extension or collectives under the 1993 Act.
IN short, there are new forms for any claim to acquire the freehold of a house or a lease extension for a house after 22 January 2025.
