The Court of Appeal has granted the Claimant permission to appeal in
Tanfield Talks “The Contractual Duty of Good Faith – when does it arise, and what does it require?”
Andrew Butler QC and Edward Blakeney delivered a virtual seminar on this developing area of law, looking at recent case-law such as Post Office v Bates (2019) and Essex County Council v UBB Waste (2020). The talk will place particular focus on how the Courts have interpreted express obligations to act in good faith, and explore the circumstances in which similar obligations will be implied. This is becoming a key area in property and commercial law, and is essential learning for solicitors practising in those areas.
Andrew and Edward have collaborated on a number of high profile cases, and have appeared together in the Commercial Court, Court of Appeal and Supreme Court. Andrew has been short-listed for “Barrister of the Year” in the 2020 Lawyer Awards, while Edward is one of Tanfield’s most promising juniors, with a practice far beyond his level of call.
