Tanfield Talks “Defending Mortgage Possession Proceedings 2021”
In this new webinar, Sam Madge-Wyld goes into considerable detail about the changed landscape of mortgage possession proceedings, an area of law that many of us have had little experience of since the LASPO legal aid reforms. Mortgage work is now no longer under the mandatory gateway and so now is a good time for all housing lawyers to re-familiarise ourselves with this important area of law and make sure we are up to date with the latest developments.
Sam is the mortgage specialist on the Defending Possession Proceedings team. Part 5 of the revised book has been re-structured and expanded so that it now covers in-depth detailed analysis on possession claims against all owner occupiers of residential premises, whether they are lessees (both under conventional long leases and shared ownership leases) facing forfeiture, mortgage borrowers facing a claim for possession or an order for sale, owners who have become insolvent or owners who are beneficiaries under a trust of land.
The section on mortgages has, in particular, been expanded to cover many more types of defences that can be run to defeat claims brought by mortgage.
