The Court of Appeal has granted the Claimant permission to appeal in
Riverside v Unsdorfer: Can a tribunal appointed manager survive a change in landlords?
In Riverside v Unsdorfer [2022] UKUT 98 (LC), the UT provides a potential solution to the issue of retaining a tribunal appointed manager when the landlord changes hands. Other thorny and important issues were raised, but have been left for another day. The Appellant landlord lost the appeal though because they had not raised the issue on appeal before the FTT and had they done, the UT considered events would have been very different.
Three members of chambers, Philip Rainey QC, Daniel Dovar and Jonathan Upton acted for the successful Respondents.
