Judgment handed down in McDonald v McDonald & Others

Tanfield’s Kerry Bretherton QC, Rebecca Cattermole and Diane Doliveux appeared in the decision of the Supreme Court which was handed down on 15 June 2016. The Supreme Court confirmed that the safeguards required by Article 8 ECHR are met by the legislative scheme. This case is of great importance to banks and lenders and is potentially of wider application.
