Implementation of the Building Safety Act 2022 continues to move at pace. The Supreme Court’s recent judgment in URS Corporation Ltd v BDW Training Ltd [2025] UKSC 21 has been described as a milestone by sector specialists. Alongside this, the Court of Appeal’s consecutive decisions in Adriatic Land 5 Limited v Long Leaseholders of Hippersley Point [2025] EWCA Civ 856 and Stratford Village Development Partnership v Triathlon Homes LLP [2025] EWCA Civ 846 have provided much-needed clarity on the retrospectivity of service charge protections and the scope of remediation contribution orders. The recent Upper Tribunal decision in Almacantar v de Valk is another “must-know” case on Schedule 8 protections.
