Andrew Butler KC obtains judgment in long-running BPC dispute

On Monday 27 January 2025, Andrew Butler KC succeeded in obtaining judgment in the long-running litigation between Vanessa Wurm and Kash Amini (Wealthy socialite, 40, accuses her crypto trader ‘wellness’ guru ex, 34, of squandering her money on £45,000 of luxury clothes including silk pyjamas in bitter court battle | Daily Mail Online).
The matter had been listed for an adjourned Costs and Case Management Conference, and Andrew’s clients had made a fresh application for judgment based on what they said were continuing failures of disclosure on the part of Mr Amini and his company, Maslife Ltd.
In what appeared to be a last throw of the dice, Mr Amini did not file evidence opposing the application, but instead made an application for his own bankruptcy. The application was issued at 10.20am on the day of the hearing. He also appointed administrators in relation to the company; the Notice of Appointment and supporting documents being filed at 11.10am.
With Sami Allan, a pupil in Chambers, undertaking key research while Andrew was in court, Andrew was able to persuade the Court that it should not stay the claim against Mr Amini as it had power to do under s.285 Insolvency Act 1985, and that it had jurisdiction to order the continuation of proceedings against the company, notwithstanding the terms of para.43(6) of Schedule B1 to that Act, which provides that on the appointment of an administrator a moratorium on legal process comes into force. The crucial and possibly decisive point on that submission was found and e-mailed over by Sami just as the Master was starting his judgment, enabling Andrew to put the material before him in time.
The result was that the Court entered judgment for the Claimants in the sum of £3.9m together with costs and interest, and also ordered the delivery up of a range of high-value goods, including a Ferrari GTS 812 as well as various valuable watches and items of jewellery and clothing.
A claim for knowing receipt and dishonest assistance against Mr Amini’s brother, and companies associated with him, continues.
